States are increasingly considering laws establishing employment eligibility verification requirements. In Pennsylvania, one such bill has been enacted. Though the demand for quick action that compels Pennsylvania lawmakers and their colleagues across the nation is understandable, creating a patchwork of uncoordinated verification systems undermines the efficacy of existing and potential federal approaches.

HB 2319: Final version (May 11, 2006) prohibits state contractors from knowingly employing, or knowingly permitting their subcontractors to employ, undocumented workers. It is an affirmative defense to the violation if the employer establishes that it has required the contractor to certify compliance with the Immigration Reform Control Act of 1986 and has notified the appropriate federal authority upon learning of the violation.
